Abstract

ملخّص: إن موضوع التعسف في استعمال الحقوق عموماً والحضانة بصفة خاصة من المواضيع المتجددة بتجدد أشكال التعسف وطرقه على الرغم من الجهود التشريعية المبذولة لحماية الطفل، من خلال تكريس نصوص قانونية منسجمة، تضمن حماية حقوق المحضون من الضياع من خلال تفضيل مصلحة المحضون والموازنة بين حقوق المطلقين ومنع التعسف الواقع بينهما من خلال تبيان ما لكل منهما من حقوق والتزامات مخولة له بمقتضى الشرع و القانون،حرصا على ضمان أفضل رعاية للمحضون.
