Abstract

رغم ما للمقاولة الفرعية من دور في التنمية الاقتصادية و التنظيم الحسن لسير سوق العمل، إلا أنها مع ذلك، يمكن أن تنعكس سلبا على التنمية الاقتصادية ذاتها، إذا ما اقتصرت على التزود باليد العاملة بهدف تحقيق الربح لكونها ستشكل منافسة غير مشروعة، فضلا عن إعاقة التنمية الاجتماعية لما يترتب عنها من هضم لحقوق العمال في حالة عدم ضبط تطبيقاتها بنصوص صارمة، و هو الوضع في الجزائر أمام عدم تنظيم أحكاما في المجال الاجتماعي أو على الأقل تفعيل ما تضمنه مشروع قانون العمل من أحكام، و إن كانت لا تحول كليا دون إمكانية المتاجرة في اليد العاملة.
