الاحكام الفقهيه المتعلقة بالمراة في مجال معاملات -الولاية نموذجا-

Abstract

"تحدثنا في بحثنا هذا عن الأحكام الفقهية المتعلقة بالمرأة في مجال المعاملات"" الولاية"" أنموذجا، فالولاية سلطة شرعيَّة يملك بها القادر على التصرف رعاية شؤون غيره. وقد اشترط أكثر الفقهاء شرط الذكورة في الولاية إلا أن هناك من لم يشترطها، وكل استند إلى أدلة ونصوص. وهنا منشأ حكم تولية المرأة، فهل يجوز للمرأة أن تكون والية على غيرها أم لا؟ وقد جاء في هذا البحث ذكر أهم شروط الولاية وأنواعها، وفي المبحث الثاني حكم تولية المرأة القضاء وهيئة الرقابة وقمع الغش, وفي المبحث الأخير حكم تولية المرأة في عقد النكاح وفي البرلمان. والراجح في كل من المسائل الثلاث الأولى _والله أعلم_ هو مذهب القائلين بعدم جواز تولية المرأة ، لقوة أدلتهم، وسلامتها، أما المسألة الأخيرة فتم ترجيح مذهب القائلين بالجواز وفق ضوابط شرعية لابد من إقامتها. "In our research, we talked about the jurisprudential rulings related to women in the field of transactions, “guardianship” as a model, for guardianship is a legal authority by which the one who is able to act has the care of the affairs of others. Most of the jurists have stipulated the condition of masculinity in guardianship, but there are those who did not stipulate it, and each relied on evidence and texts. Here is the origin of the rule of guardianship of women, so is it permissible for a woman to be a guardian over others or not? In this research, the most important conditions for guardianship and its types were mentioned, and in the second section, the rule of women taking over the judiciary and the control body and the suppression of fraud, and in the last section, the rule of the guardianship of women in the marriage contract and in Parliament. The most correct in all of these issues - and God knows best - is the doctrine of those who say that it is not permissible for a woman to be appointed by a woman, because of the strength and soundness of their evidence.
