الآثار المترتبة عن الاكتتاب

Abstract

لا يختلف عقد الاكتتاب عن سائر العقود بكون مصدره إرادة المتعاقدين؛ لكن تحديد آثاره يتولاه القانون لمصلحة المكتتب والشركة والاقتصاد الوطني بصفة عامة. وفي هذه الصفحات بيان لما يرتبه عقد الاكتتاب من حقوق والتزامات بين أطرافه؛ بالنسبة للمكتتب في مبحث أوّل، ثم بالنسبة للمؤسسين وشركة المستقبل في مبحث ثان. مع مراعاة أن تلك الآثار لا تتجسد إلا حالة نجاح عمليّة الاكتتاب وما تؤدّيه من اكتمال الوجود القانوني للشركة.
