Abstract

"ملخص هذه الدراسة موسومة بقاعدة اعتبار المآل وأثرها في نوازل الأسرة -نماذج مختارة- كان الإشكال الرئيس فيها: ما مدى تأثير قاعدة اعتبار المآل على نوازل الأسرة؟ عُولجت هذه الإشكالية في ثلاث مباحث، حيث تناولنا في المبحث التمهيدي: تعريف نوازل الأسرة وأهمية الإجتهاد فيها وضوابط الإجتهاد في النوازل، وجعلنا المبحث الأول: تعريف للقاعدة ومشروعيتها ومراتبها وضوابطها، وأما المبحث الثاني: فخصصناه لبيان أثر القاعدة المقاصدية في نوازل الأسرة. توصلت الدراسة إلى جملة من النتائج لعل من أهمها: أن قاعدة اعتبار المآل يجب الإعتناء بها وعدم إهمالها في الإجتهاد والإفتاء، كما أوصت الدراسة بوجوب تقدير المآلات حين إعطاء الأحكام لهذه النوازل والمستجدات.""Abstract: This study is based on consideration result, which has influence on cataclysms of relatives - chosen models - The main problem was: To what extent is consideration result impact relative cataclysms?. This problematic has been treated umto there chaptess introductory chapter: it has been tackled the definition of family, the legal opinion and its importance particularly in hard times, in the first chapter:i has been tackled the definition of dictate in family cataclysms. this study has concluded to results: the base consideration result should be taken care of it and not to ignore it in the field of legal opinion, the study also recommended that the results should be evaluated when passing judgments on cases and development."
