دور الدبلوماسية في إدارة العلاقات الدولية دراسة مقارنة بين الفقه الإسلامي والقانون الدولي العام

Abstract

تناولت هذه الدراسة دور الدبلوماسية في إدارة العلاقات الدولية بين الفقه الإسلامي والقانون الدولي العام، حيث بيّنت الدور الذي تلعبه الدبلوماسية في تعزيز العلاقات بين شعوب العالم. قُسِمَت الدراسة إلى ثلاث مباحث، بمبحث أول عالج مفهوم الدبلوماسية وأنواعها ومصادرها، وأبرز التحولات التي مرّت بها عبر التاريخ، وفي مبحث ثاني أسسّها من حيث المبادئ العامة للعمل الدبلوماسي ووظائفها، وتأثير الإخلال بها على العلاقات الدولية، وعرّج المبحث الثالث على أساليب وطرق العمل الدبلوماسي من مفاوضات و وساطة ومساعي حميدة وغيرها ، ودورها في تسوية النزاعات بالطرق السلمية، فكانت الدراسة وفق المنهج الوصفي بضبط المفاهيم المتعلقة بالموضوع،والتحليلي بتفسير الأدلة الشرعية والنصوص القانونية، والمنهج المقارن بمقارنة الوظائف الدبلوماسية بين الفقه الإسلامي والقانون الدولي، فكانت حصيلة العمل الوصول إلى نتائج وتوصيات أهمها، أن الشريعة الإسلامية كانت سبّاقة للعمل الدبلوماسي من أجل إحقاق السلم والأمن الدوليين،فتكامل معها القانون الدولي العام من حيث المبادئ والأهداف. أما العمل بالقانون الدولي نظري تنقصه الواقعية ."Abstract: This study investigated the role of diplomacy in managing international relations in both Islamic jurisprudence and public international law, as it demonstrated the role that diplomacy plays in strengthening relations between the peoples of the world. The study has been divided into three sections. The first section dealt with the concept of diplomacy, its types and sources, and highlighted the most prominent transformations it had undergone throughout history. The second section established its foundations in terms of the general principles of diplomatic work and its functions, and the impact of breaching them on international relations. The third section had covered the methods and methods of diplomatic work from Negotiations, mediation, good offices, etc., and their role in settling disputes by peaceful means. The study was according to the descriptive approach by controlling the concepts related to the subject, the analytical approach by interpreting Sharia evidence and legal texts, and the comparative approach by comparing diplomatic functions between Islamic jurisprudence and international law. The outcome of the work was to arrive at results and recommendations, the most important of which were Islamic law was the forerunner of diplomatic work in order to achieve international peace and security, so public international law was integrated with it in terms of principles and goals. Working according to international law is theoretical and lacks realism.
