الإشكالات التي تثيرها الفقرة "أ" في المادّة الثانية من قانون الوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال ومكافحتها

Abstract

ينصّ المشرّع الجزائري في الفقرة "أ" من المادّة الثانية من قانون الوقاية من الجرائم المتّصلة بتكنولوجيات الإعلام والاتّصال ومكافحتها على تعريف الجرائم الإلكترونيّة, غير أنّه وهو بصدد تعريفها يبدو أنّه من جهة اصطدم بمبدأ الشّرعية الجنائيّة, ومن جهة أخرى لم يستوعب النصّ كلّ الجرائم التّي تُرتكب في بيئة إلكترونية, وكلّ ذلك كان بسبب الصّياغة العامّة للنصّ.
