أخلاقيات التعليم الجامعي بين التشريع القانوني والالتزام الأخلاقي

Abstract

الأخلاق المتضمنة في ميثاق أخلاقيات التعليم الجامعي بقوتها الذاتية لا يمكن أن تكون بديلا عن التشريعات القانونية خاصة في الوسط الجامعي الجزائري فقوة الأخلاق الذاتية لا يكون لها معنى في غياب تفعيلها عمليا فالترسانة النظرية التي تشكل ميثاق أخلاقيات التعليم الجامعي لا غبار عليها ولكن سيعتريها النقص ولن تؤدي وظيفتها التي وُجدت لأجلها إذا لم يكن لها نصيب من الالتزام الواقعي والتطبيق العملي. القوة الذاتية للأخلاق هي مرحلة متقدمة جدا يجب أن نؤسس لها بشكل صحيح حتى نستمتع بكل ميزاتها ويجب التوعية بأهمية ميثاق أخلاقيات التعليم الجامعي، فلا يمكن الحديث عن القوة الذاتية في غياب التوعية بأهمية هذا الميثاق فنسبة كبيرة من المنتمين للوسط الجامعي يجهلون حتى وجوده فما بالك بتفاصيله. كما يتعين على المسؤولين تفعيل الجانب التطبيقي لهذا الميثاق عن طريق المراقبة والمتابعة القانونية، فالجرم الأخلاقي لا يقل خطورة عن الخرق القانوني للنظام الجامعي. في الجامعة الجزائرية التشريع القانوني و الميثاق الأخلاقي كلاهما مهم فالأول يدعم الثاني، فالتشريعات القانونية تلعب دور الضابط الموضوعي- إن صح القول-، وميثاق الأخلاقيات يمثل الضابط الذاتي الذي من الصعب الوقوف عند مؤشراته لذلك يحتاج إلى دعم وسند قانوني حتى يكتسب نوعا من السلطة والضبط. ميثاق أخلاقيات التعليم الجامعي بقوته الذاتية لا يمكن أن يكون بديلا عن التشريعات القانونية إلا إذا توفر الالتزام الأخلاقي الجاد وسادت سلطة الضمير الحي والمراقبة الذاتية المستمرة، وتلك الميزات من الصعب أن تتوفر في كل أفراد الأسرة الجامعية هنا يظهر التشريع القانوني ليلـــزم من صعب عليه إلــــزام نفسه وضبط ذاته. يأتي هذا المقال كمحاولة لمعالجة ذلك الإشكال القائم بين التشريع القانوني والرغبة الذاتية لتنفيذ أخلاقيات الأستاذ الجامعي.Ethics contained in the charter of ethics for university education with its own power cannot be a substitute for legal legislation, especially in the Algerian university community. In the Algerian University, the legal legislation and the moral charter are both important, the first supports the second, the legal legislation plays the role of the objective officer - if it is true -, and the ethics charter represents the self-control that is difficult to stand at its indicators so it needs legal support and support in order to gain a kind of authority and control. The charter of ethics for university education with its own power cannot be a substitute for legal legislation unless there is a serious moral commitment and the authority of conscience and continuous self-monitoring prevails, and these features are difficult to have in all members of the university family. same.
