دور التدابير العلاجية في مواجهة الخطورة الإجرامية – في الفقه الإسلامي والقانون الجزائري-

Abstract

" يتناول البحث أهمية التدابير العلاجية في الحد من الجريمة والحد من خطر الجرائم المستقبلية، وذاك من خلال إبراز أهميتها وخصائصها والمبادئ التي تقوم عليها، واخترنا عينة من التدابير العلاجية؛ وهي خضوع مدمني المخدرات إلى العلاج مقابل اعفائهم ممن المتابعة الجزائية، والتي يريد من خلالها المشرع الذهاب به من مجرد مجرم تسلط عليه العقوبة، إلى كونه مريضا يحتاج إلى علاج. وكان من أهم النتائج المتوصل إليها،أن التدابير العلاجية إذا تم تطبيقها بفعالية عالية، واستجاب المجرم لها يكون لها إسهاما كبيرا في مواجهة الخطورة الإجرامية.

This is done by highlighting their significance, characteristics, and underlying principles. We selected a sample of therapeutic measures, specifically the treatment of drug addicts in exchange for exempting them from criminal prosecution. Through this approach, the legislator aims to transform the perception of the offender from a mere criminal subject to punishment to a patient in need of treatment.One of the key findings is that if therapeutic measures are effectively implemented and the offender responds to them, they can significantly contribute to confronting criminal risk.
