التدابير التربوية المؤقتة المتخذة أثناء التحقيق القضائي مع الحدث الجانح

Abstract

قد خص المشرع الجزائري جهات التحقيق –قاضي الأحداث أو قاضي التحقيق المختص بشؤون الأحداث ،وعلى غرار السلطات الممنوحة لقسم الأحداث ، بسلطة إصدار جملة من التدابير المؤقتة أثناء مرحلة التحقيقالقضائي مع الحدث الجانح ،وهي تدابير ذات طبيعة تربوية ورد النص عليها في المادة 70 من قانون حماية الطفل، و هذه التدابير التي يتخذها قاضي الأحداث تهدف إلى الإبقاء على الحدث قدر الإمكان في وسطه العائلي أو لدى شخص جدير بالثقة ،كما قد تؤدي إلى إبعاد الحدث عن وسطه الطبيعي، وذلك بوضع الحدث المتابع في مؤسسة معتمدة مكلفة بمساعدة الطفولة أو الوضع في مركز متخصص في حماية الطفولة الجانحة،ويمكن القول بأن هذه التدابير استثنائية لا يتخذها القاضي في مواجهة الحدث الجانح إلا إذا ارتأى الضرورة الملحة لذلك. الكلمات المفتاحية: الحدث الجانح، التدابير المؤقتة، التحقيق القضائي، مراجعة التدابير، قاضي الأحداث. Abstract: The Algerian legislature has assigned the investigative bodies, the juvenile judge or the investigating judge in charge of juvenile affairs, and similar to the powers given to the Juvenile Department, the authority to issue a set of interim measures during the judicial investigation stage with the juvenile delinquent. These educational measures which are stipulated in the article 70 of the Child Protection Act are taken by the juvenile judge to keep the juvenile as much as possible in his family or with a trustworthy person. It may also lead to the removal of the juvenile from his natural environment, by placing the prosecuted juvenile in an accredited institution charged with child assistance or in a specialized center of the protection of delinquent childhood. It is possible to say that these exceptional measures are not taken by the judge to prevent juvenile delinquency when it is necessary.
