قواعد الحذر في تسيير المخاطر البنكية في القانون الجزائري

Abstract

تهدف هاته الدراسة إلى إبراز أهم القواعد والأحكام القانونية والتنظيمية التي سنها المشرع الجزائري للتصدي للمخاطر البنكية وطرق تسيير المخاطر والإبلاغ عنها والوقاية منها ودورها في حماية النظام المصرفي الجزائري . كما نحاول من خلالها دراسة مدى مسايرة النظام المصرفي الجزائري للتطورات العالمية في مجال الوقاية وتسيير المخاطر البنكية لاسيما قواعد بازل . إن هاته الدراسة تعد مدخلا مهما لإدراك مفهوم المخاطر البنكية و قواعد الحذر البنكي و أهم قواعدها وأحكامها , كما تسلط الضوء على إجراءات تطبيق هاته القواعد من طرف البنوك والجزاءات المترتبة عن عدم احترام هاته الإجراءات.This study aims to highlight the most important legal and regulatory rules, which enacted by the Algerian legislator. To deal with banking risks, finding ways of managing risks, reporting and preventing them. Also, to show their role in protecting the Algerian banking system. In addition, we are trying to study the extent to which the Algerian banking system is consistent with the global developments, in the field of prevention and the management of bank risks, especially the Basel rules. This study is an important contribution to the understanding the concept of bank risks, the rules of banking caution and the most important their rules and provisions. Moreover, highlights the procedures for applying these rules by banks and the penalties resulting from non-compliance with these procedures.
