Abstract

ABSTRACT The aim of this research, labeled “The Purposes of the Necessary Sharia According to Ibn Daqeeq Al-Eid, Through His Explanation of the Umdat Al-Ahkam” is manifested in reviving the well-established sciences written by the ancient jurists, highlighting their jurisprudential and scientific status, and showing their efforts in spreading and teaching science, and my desire to benefit from the existing gems of intentions In the book Ahkam al-Ahkam, the explanation of Umdat al-Ahkam by Ibn Daqiq al-Eid - may God have mercy on him - especially as it reveals the secrets of legislation, and the wisdom of God’s commands and prohibitions. judgments. After this modest effort, I concluded that Imam Ibn Daqeeq Al-Eid - may God have mercy on him - cares about the necessary objectives of Islamic law -the five colleges-. يتجلى هدف هذا البحث الموسوم بــــــــ "مقاصد الشريعة الضرورية عند ابن دقيق العيد من خلال شرحه على عمدة الأحكام" في إحياء ما كتبه الفقهاء المتقدمون من علوم راسخة، وإبراز منزلتهم الفقهية والعلمية، وتبيين جهودهم في نشر العلم وتعليمه، ورغبتي في الاستفادة من الجواهر المقاصدية الموجودة في كتاب إحكام الأحكام شرح عمدة الأحكام لابن دقيق العيد -رحمه الله-، خاصة وأنها تكشف عن أسرار التشريع، والحِكمة من أوامر الله ونواهيه، فالشريعة الإسلامية جاءت بتحقيق المصالح ودفع المفاسد، وإقامة الناس على العبودية، حيث يُعتبر هذا الشرح النفيس من أهم شروح عمدة الأحكام. وبعد هذا الجهد المتواضع استخلصت أن للإمام ابن دقيق العيد-رحمه الله-عناية بمقاصد الشريعة الإسلامية الضرورية (الكليات الخمس)، فقد ذكر أمثلة تطبيقية لها في حفظ الدين والنفس والنسل والعقل والمال.
