حماية الحق في حرمة الحياةالخاصة في الفقه الاسلامي و القانون الجزائري

Abstract

تعنى هذه الدراسة بموضوع ذي أهمية بالغة وجدير بالبحث، وهو الحياة الخاصة وما يتعلق بها من الحقوق اللصيقة بشخص الانسان، ولذلك تمثلت اشكالية الموضوع في : ماهي الضمانات التي كفلتها الشريعة الاسلامية والمشرع الجزائري لحماية الحياة الخاصة للأفراد والى أي مدى وفق المشرع الجزائري في التنصيص على ذلك؟ حيث تضمنت الدراسة مبحث أول نظري قمنا فيه بتعريف مصطلحات الدراسة، ومبحث ثاني الحماية المدنية للحق في حرمة الحياة الخاصة أما المبحث الثالث الحماية الجنائية والاجرائية للحق في حرمة الحياة الخاصة " Abstract This study deals with a topic of great importance and worthy of research, which is private life and the rights attached to the human person, therefore, it is considered to be the topic of the subject: ""What are the guarantees of Islamic law and Algerian legislator to protect private life to individuals? and however, the Algerian legislator in the counsel?"" the study included: First theoretical topic in which we defined the terms of the study, the second topic is the civil protection of the right to the sanctity of private life, And the third topic is the criminal and procedural protection of the right to the sanctity of private life. "
