تبــادل البعثــات الدبلــوماسيـة دراسة مقارنة في الفقه الإسلامي والقانون الدولي

Abstract

"الملخص: ملخص: تناول البحث تبادل البعثات الدبلوماسية في الفقه الإسلامي والقانون الدولي، حيث يظهر الدور الذي يلعبه تبادل البعثات الدبلوماسية في تحقيق المصالح المشتركة بين الدول والشعوب. قسم البحث إلى مبحثين: تناول المبحث الأول الإطار المفاهيمي لتبادل البعثات الدبلوماسية، من خلال التطرق لمفهوم البعثة الدبلوماسية ومراحل التطور التاريخي للتمثيل الدبلوماسي، ثم أنواع ووظائف البعثة الدبلوماسية. أما المبحث الثاني خصص للأسس الشرعية والقانونية لتبادل البعثات الدبلوماسية، المتمثلة في مشروعية تبادل البعثات الدبلوماسية وصفات وشروط المبعوث الدبلوماسي، ليختتم بحقوق وواجبات الرسل والسفراء. خلص البحث إلى جملة من النتائج أهمها أن الفقه الإسلامي يتطابق مع القانون الدولي في معاني ومضامين مصطلح الدبلوماسية ومشمولاته التطبيقية، وإن اختلفت إطلاقاته، وله عميق الأثر في تأسيس وإثراء قواعد القانون الدولي المنظمة للوظيفة الدبلوماسية. The research addresses the exchange of diplomatic missions in Islamic jurisprudence and international law, highlighting the role of diplomatic missions in achieving mutual interests between countries and peoples. The study is divided into two sections: the first section deals with the conceptual framework of the exchange of diplomatic missions, discussing the concept of diplomatic missions, the historical evolution of diplomatic representation, and the types and functions of diplomatic missions. The second section is dedicated to the legal and religious foundations of the exchange of diplomatic missions, which include the legitimacy of exchanging diplomatic missions and the qualifications and conditions of the diplomatic envoy, concluding with the rights and duties of messengers and ambassadors. The research concludes with several findings, the most important of which is that Islamic jurisprudence aligns with international law in the meanings and implications of the term diplomacy and its practical applications, despite differences in terminology. Islamic jurisprudence has a profound impact on the establishment and enrichment of international law governing diplomatic functions.
