دور التوثيق في حماية الحقوق بين الفقه الإسلامي والقانون الجزائري

Abstract

الملخص هذا البحث يتناول دور التوثيق في حماية الحقوق بين الفقه الاسلامي والقانون الجزائري ويستمد مبادئه من نصوص القرآن الكريم والسنة النبوية والنصوص التي وضعها ونظمها المشرع الجزائري. ليتضح لنا أن التوثيق هو السبيل الأمثل لحماية وحفظ الحقوق إذ تعددت أساليبه وطرقه ولعل انجع وابرز هذه الطرق هي التوثيق الكتابي فهو الدليل القوي في اثبات الحقوق وحفظها. فيتطرق هذا البحث إلى مفهوم التوثيق في الفقه الإسلامي والقانون الوضعي الجزائري وتطوره التاريخي عبر الحقب الزمنية التي مرى بها, ثم عناصر التوثيق من عقد وإشهاد وكتابة وأخد الموثق نصيبه من هذا البحث من حيث تعريفة وتنظيم مهنته من شروط والتزامات واختصاصات, وبما أن مجالات التوثيق واسعة ومتعددة فكان عقد الوقف من بين العقود التي أهتمت الشريعة الإسلامية بتوثيقه واثباته وهذا ما سار عليه المشرع الجزائري, بل شدد على الرسمية في ذلك. وفي ختام البحث خلصنا إلى نتائج أهمها: أن الشريعة الاسلامية كانت سباقة في اثبات وتوثيق العقود والمعاملات بل جعلت منه علما قائما بذاته بينما اعتبره المشرع الجزائري وظيفة دنيوية تشمل كافة الضمانات والاجراءات القانونية الكفيلة بحفظ الحقوق وشدد على ذلك بترسانة من التشريعات الضابطة له. الكلمات المفتاحية: عربية: الشريعة الاسلامية – القانون الجزائري – التوثيق – الرسمية – الاشهاد المكتوب – الوقف.

Summary This research deals with the role of documentation in the protection of rights between Islamic jurisprudence and Algerian law and derives its principles from the texts of the Holy Koran, the Prophetic Sunnah and the texts drafted and organized by the Algerian legislature. It is clear to us that authentication is the best way to protect and preserve rights. Its methods and are numerous. Perhaps the most effective and most important of these methods is written documentation. This research looks at the concept of documentation in Islamic jurisprudence and Algerian positive law and its historical development through the chronological period in which it was carried out. The notary has taken part in this research in terms of the definition and regulation of his profession in terms of terms of conditions, obligations and competencies. Since the areas of documentation are wide and wide, one of the contracts in which the Islamic Sharia has been responsible for documenting and proving it is the case of the Algerian legislator. At the conclusion of the research, we found the most important results: The Algerian legislator considered it to be a mundane function, including all the guarantees and legal procedures necessary to safeguard rights.
