الحقوق المالية للجنين في الشريعة الإسلامية والقانون الوضعي

Abstract

يعالج بحثنا الموسوم بعنوان: الحقوق المالية للجنين في الشريعة الإسلامية والقانون الوضعي، إشكالية مفادها: ماهي الحقوق المالية التي منحتها الشريعة الإسلامية والقوانين الوضعية للجنين؟ وقد تم الإجابة على هذا الإشكال ضمن ثلاثة مباحث، كل مبحث مزدوج المطالب، حيث تطرقنا في المبحث الأول إلى ماهية الحقوق المالية للجنين في الشريعة الإسلامية والقانون الوضعي، أمَّا المبحث الثاني تناول الحقوق المالية للجنين في ظل حالات الحمل العادية، وخُصِصَ المبحث الثالث بعنوان الحقوق المالية للجنين في ظل حالات الحمل غير العادية، وقد تُوِجَ البحث بعدة نتائج أهمها: اهتمام الشريعة الإسلامية والقوانين الوضعية اهتمامًا كبيرًا بحقوق الجنين، خاصة المتعلقة بالشّق المالي؛ لما فيه من تأثير بالغ على جميع مجالات الحياة، لذلك كانت أهم التوصيات التي أوصينا بها هي: ضرورة إنشاء الدولة لهياكل أكثر تخصص مرفقة بإجراءات صارمة من أجل الحفاظ على هذه الحقوق أكثر."Our research, entitled: The financial rights of the embryo in Islamic sharia and positive law, addresses its problem: What financial rights have been granted by Islamic law and the positive laws of the embryo? This problem was answered within three chapters, the first chapter defines the financial rights of the fetus in Islamic law and statutory law, the second chapter deals with the financial rights of the fetus in cases of normal pregnancy, and chapter three, the financial rights of the fetus in cases of abnormal pregnancy. The research concluded with the most important results: the interest in Islamic law and positive laws, great concern for the rights of the fetus, especially the financial aspect because it has a great impact on all areas of life, the most important recommendations were: The need for the state to establish more specialized structures attached to strict procedures in order to preserve these rights more."
