العقوبات الاقتصادية الدولية الانفرادية في المجتمع الدولي المعاصر

Abstract

عرف المجتمع الدولي المعاصر العقوبات الاقتصادية الانفرادية، وهي التي توقعها دولة أو مجموعة دول ضد دولة أو مجموعة دول، ارتكبت فعلا غير مشروع، خارج المنظمات الدولية، العامة أو المتخصصة أو الإقليمية، إلا أن المرتكز فيها هو أن توقع في إطار الشرعية الدولية، وأحكام القانون الدولي، وإلا اعتبرت مجرد ضغوط قد تصل إلى درجة العدوان الاقتصادي، الذي قد يفوق العدوان العسكري. وتختلف هذه العقوبات بين الجزئية والشمولية بأن تشمل قطع كل العلاقات الاقتصادية والشخصية، وبين السلبية والايجابية، وبين تغطيتها للمجالات الأهلية، أو تكون بإشراف السلطات الرسمية. في كل ذلك، وسواء كانت قصاصا، أو معاملة بالمثل، يجب أن تكون في إطار الشرعية الدولية. Abstract: At present time ,the world community has become well acquainted with the proper applying of individual economic sanctions by one or a group of states to one or more faulty state having transgressed some strict rules adopted by major world or regional organization concerned by global or special issues. These sanctions are nevertheless, confined to the framework of world legitimacy and to be in accordance with the general legislation, otherwise these sanctions would be considered as mere pressures, it might reach an economical aggression which could be worse than military one. They also differ whether they include partial or total sanctions, as the breaking of all economical and public relations, and as being negative or positive measures, covering areas of justifiability or being supported by official authorities. In all these cases they should not override world legitimacy whether intending retaliation or reverse disposition.
