Abstract

إن المسؤولية الجنائية ترمي إلى تحميل الشخص تبعة عمله المجرم بإخضاعه للجزاء المقرر له ، إذ انه لا يمكن تحميل الشخص المسؤولية الجنائية إلا إذا ثبت في حقه خطا يشكل جرم في القانون والفقه ويجب أن يتوفر في ذلك الشخص ما يجعله أهلا للمسؤولية الجزائية وذلك لان المسؤولية المدنية لهذه الأشخاص المعنوية لم تعد كافية لمنعها وردعها عن تلك الأفعال المجرمة الناتجة عنها بسبب حاجة الناس إليها وكذلك بسبب التطور الاجتماعي هذا مما أدى إلى التفكير لإخضاعها للمسؤولية الجزائية لردعها حيث أن موضوع بحثنا يعالج فكرة المسؤولية الجزائية للشخص المعنوي حيث تطرقنا إلى تعريف الشخص المعنوي ثم عرفنا المسؤولية الجزائية ثم تطرقنا إلى أهمية وخصائص الشخص المعنوي ثم تطرقنا إلى الجدل الفقهي القائم حول هذه المسالة وما هي العقوبة المقدرة لهده الأشخاص المعنوية في أيطار هذه المسؤولية the criminal responibility is intended to hold each person responsible for the w0rk of the offender by subjecting him to the prescribed responsible unless he is proven to be q criminal offense in law and jurisprudence and must be available in that person ,recognition of the legal personality of moral pesons to s ubject them to criminal responsibility because the civil liability of these persns is no longer sufficient to prevent and deter them from the forbiden acts resulting from them because of the need of people from the forbidden qcts resulting from them because of the need of people and because of this social development , which led to think of subjecting them to criminal resposibility to deter them where the subject of our research deals with the idea of criminal responsibility we discussed the importance and charcristics of moral berons we also discussed the jurisprudential debate on this issue and what is the estimated punishment of these moral persons under
