اقتضاء الأمر الإرادة وآثاره الفقهية

Abstract

تناولت في بحثي مسألة اقتضاء الأمر الإرادة وهي من المسائل المشتركة بين أصول الفقه وأصول الدين ؛ حيث عرفت الإرادة من حيث اللغة ومن حيث الاصطلاح اللغوي العام، ثم الشرعي الخاص، واخترت منها ما يوافق الاستقراء الشرعي، ، ثم ذكرت أهم الفروق الجوهرية بين الإرادتين الشرعية والكونية، ثم ذكرت الخلاف في مسألة اقتضاء الأمر الإرادة،وخلصت إلى أن الأمر يستلزم الإرادة الشرعية دون الإرادة الكونية التي هي بمعنى المشيئة العامة النافذة، ثم ذكرت نوع الخلاف؛ حيث إن من الأصوليين من يجعله لفظيا ، لا ثمرة له ، ومنهم من عده معنويا ويرتب عليه آثارا عملية، أصولية وفقهية وعقدية.
