Abstract

"هذه الدراسة الموسومة بــ: البعد المقاصدي للرخصة الشرعية -العبادات أنموذجا- كان الإشكال الرئيس المتضمّن الذي تسعى إلى الإجابة عنه هو: إلى أي مدى يمكن اعتبار المقاصد مؤثرة في تقرير استثناءات لبعض أحكام العبادات؟ أجابت الدراسة عن ذلك من خلال مباحث الآتية: المبحث التمهيدي وتمّ فيه التعريف بالمقاصد، وبيان حجيتها، ومراتبها، وطرق إثباتها. أما المبحث الأول فقد خصّصته بتعريف الرخصة الشرعية، وأدلّة ثبوتها وأقسامها، أسبابها وضوابطها وأخيرا علاقة الرخصة بالمقاصد. وتكفّل المبحث الثاني بتطبيقات الرخصة في مجال العبادات في مسائل مختارات من الصلاة والزكاة والصوم والحج. أسفرت الدراسة على جملة من النتائج لعلّ أهمها أن الفقهاء خاصّة المعاصرين منهم قد أعملوا المقاصد في بيان مستثنيات بعض أحكام العبادات؛ وفي ذلك نماذج في باب العبادات، كما أوصت الدراسة اعتماد المتصدّرين للإفتاء منهج التيسير قدر الإمكان، فيما يتعلّق بالرخص وذلك لا يكون إلا بتتبع الأسباب وبناء على ضوابط معينة. " "Abstract This study which was characterized by: the dimension of the legitimate perspective – worshiping Allah as model - the the main problem involved used to answer was : to what extent can be considered targets of Shriah influential in determining exceptions to some provisions of worship? The thesis answered this by means of the following investigations: the introductory course, in which the objectives were defined, and the statement of its validity, and its grades, and methods of proving them. The first topic is devoted to the definition of the Islamic permission , its evidences and sections, its causes and controls, and finally its relationship to the purposes of legitimacy. The second section ensures the applications of the permission in the field of worship in matters of selection of prayer, zakat, fasting and Hajj. On a number of results perhaps the most important that the jurists, especially the modern ones, have done the purposes in the statement excluded some of the provisions of worship as recommended by the study adoption of the leaders to reject the facilitation approach as much as possible with regard to licenses and this can only be followed by the islab and based on significant controls.
