البعد المقاصدي للرخصة الشرعية في المعاملات المالية المعاصرة

Abstract

" تناول هذا البحث موضوع: البعد المقاصدي للرخصة في المعاملات المالية المعاصرة, وقد جاءت إشكالية البحث كالآتي: إلى أي مدى يمكن اعتبار المقاصد مؤثرة في تقدير الاستثناءات والرخص لبعض المعاملات المالية؟ وقد أجاب عنها البحث وفق المباحث الآتية: المبحث الأول والذي تم فيه التعريف بالمقاصد وذكر أقسامها وطرق إثباتها. والمبحث الثاني تطرقنا فيه إلى تعريف الرخصة الشرعية مع ذكر أقسامها وعلاقتها بالمقاصد. أما المبحث الثالث تضمن أثر مقاصد الرخصة في بعض المعاملات المالية, كبيع السلم. وأخيرا المبحث الرابع فقد خصصناه لذكر أثر مقاصد الرخصة في معاملات المالية المعاصرة. وقد أسفرت هذه الدراسة إلى مجموعة من النتائج أهمها أن البعد المقاصدي للرخصة الشرعية في المعاملات المالية المعاصرة قد أعمل فيه منهج التيسير ورفع الحرج فيما يتعلق بالرخص, كما يجدر الإشارة, عدم الأخذ بالرخص الشرعية إلا إذا وجدت أسبابها مع مراعاة الضوابط التي ضبطت حدود الأخذ بها. " This research discuses the destination licensing in the actual financial and to what extent it reflects in other financial intercourse. the project or the research answers the question as the following. the first research? : IL presents the difrnition of destinoti ons and it's typs. the third research: it presents the licencing destination in some financial inter courses. the second research: we spoke about the legitimate licen ce the fourth research :it is for the destinati on in the financial intercourses .we put some result from this study that the licencing destination in the financial inter courses toke ito considera tin the management. and it showed be token only if we have the reason taking into consideration the liginate law.
