نطاق التدخل القضائي في التحكيم الدولي لمنازعات الاستثمار

Abstract

كثيرا ما يتم اللجوء في المنازعات الاستثمارية إلى هيئات تحكيم متخصصة، بصفتها كبديل عن اللجوء للقضاء. وبالنظر إلى مكانة الاستثمارات وتأثيرها في الاقتصاد الوطني كان لابد من بسط سيادة الدولة من خلال تحديد مجال التدخل القضائي في الخصومة التحكيمية الخاصة بالفصل في منازعات الاستثمار لغاية الفصل فيه وصدور الحكم التحكيمي، من خلال هذه الدراسة سنعرج على أهم الخصوصيات التي تميز الخصومة التحكيمية في منازعات الاستثمار لنتطرق إلى مجال التدخل القضائي قبل وبعد الفصل في النزاع. Abstract: In the case of the investment litigation, specialized arbitration instances are often sized, as a substitute to the juridical authority. But the importance, and the statute of the investment and its influence on the national economy, impose the intervention of the state and its sovereignty by the limitation of juridical intervention field in the adversary arbitration specialized in the judgment of investment litigation, till the pronouncement of the judgment, In this paper we will focus on the most important features which represent the adversary arbitration in the investment litigation and we will precise the field of the juridical intervention, before and after deciding in the litigation.
