استخدام مبدأ التناسب في النزاعات المسلحة دراسة مقارنة بين الفقه الإسلامي والقانون الدولي الإنساني

Abstract

تناولت هذه المذكرةِ موضوع "ضوابط استخدام مبدأ التناسب في النزاعات المسلّحة، دراسة مقارنة بين الفقه الإسلامي والقانون الدولي الإنساني"، وكانت إشكاليَّتُها الرئيسةُ تدور حول مدى استخدام ضوابط مبدأ التناسب وتحقيقه لآثاره في النزاعات المسلحة، وللإجابة عليها قسمت الدراسة إلى ثلاثة مباحث: خَصّصنا المبحث الأول لبيانِ مفهوم مبدأ التناسب في الفقه الإسلامي والقانون الدولي الإنساني والمبادئ ذات الصلة به، وجُعِلَ المبحث الثاني لدراسة قيود وآثار وسائل وأساليب القتال في الفقه الإسلامي، وأما المبحث الثالث فقد عالج وسائل وأساليب القتال وآثاره في القانون الدولي الإنساني، وقد ختمت الدراسة بمجموعة مِنَ النتائجِ والاقتراحات أهمها: إبراز ضوابط مبدأ التناسب كركيزة أساسية توفر الحماية الدولية لضحايا النزاعات المسلحة، وضرورة المراجعة الجادة لضوابط استخدام وسائل أساليب القتال أثناء سير الأعمال العدائية، وكذا الالتزام بها من أجل إقامة التوازن بين الاعتبارات الإنسانية والضوابط العسكرية زمن النزاعات المسلحة الدولية. To clarify the concept of the principle of proportionality in Islamic jurisprudence and international humanitarian law the principle related to it، the second topic was established for studying the limitations and effect of tools and method of fighting in Islamic jurisprudence، and the third topic discussed tool and method of combat and it effect in international humanitarian law، and the study concluded with a set of results fand suggestions، the most important of which Highlighting the criteria conditions of the principle of proportionality as a basic fundamental that provides international protection for the victims of armed conflicts، and the need for a serious review of the control of hostilities، as well as commitment to them in order to establish a balance between humanitarian consideration and military control during international armed conflict
