Abstract

إذا وقع نزاع حول واقعة الزواج العرفي بين الزوجين، وكان أحدهما يدّعي قيام الزواج، والآخر يزعم نفيه ويطعن في قيامه أو في صحته، فإن الطريق الوحيد لإثبات ما يدّعيه المدعي هو إقامة دعوى إثبات الزواج أمام المحكمة المختصة، وإذا تمكن المدّعي من إثبات الزواج حكمت المحكمة بقيام الزواج. وتبحث هذه الصفحات في الوسائل التي يتم بها إثبات الزواج العرفي حال التنازع بين الطرفين، من خلال بيان مفهوم عقد الزواج العرفي، ثم عرض وسائل إثبات عقد الزواج العرفي.
