الإسقاط بين حكم الحيض والنفاس أو الاستحاضة

Abstract

تهدف هذه الدراسة إلى تسليط الضوء على الحكم الشرعي للدم الناتج من إسقاط المرأة جنينا، إذ اختلفت آراء الفقهاء في كونه نفاسا أو استحاضة بحسب عمر الجنين السقط، ولم يتطرقوا إلى مسألة أن يكون مجرد دورة حيض عادية، وهو الأمر الذي رأينا ضرورة البحث فيه استنادا إلى ما ورد من أحاديث نبوية، وأقوال فقهاء، والرجوع إلى الأطباء ومعرفة آرائهم، عند تقسيمهم للدم الذي يطرأ على المرأة وأسبابه مما يفيد الفقهاء في استنباط الحكم الشرعي المستند إلى الخبرة الطبية. Abstract: This study aims at looking into the Islamic ruling of the aftermath of Miscarriage, especially bleeding. And that’s due to the wide range of point of views of Jurists on whether the bleeding was Puerperium, Menorrhagia, or Metrorrhagia depending on the age of the fetus. Although none have mentioned the possibility of it being a mere Menstruation Cycle. This is why this research is based on the sayings of prophet – pbuh -, Gynecologists, and Jurists' point of view as well as their opinions on blood categories that women go through during puberty period.
