القبض الحكمي وتطبيقاته المعاصرة

Abstract

تضمنت هذه الدراسة موضوع القبض الحكمي وتطبيقاته المعاصرة وذالك من جانبين، نظري والآخر تطبيقي، أما الجانب النظري التأصيلي، ففيه بيان لحقيقة القبض بنوعيه الحقيقي والحكمي وما يتعلق بهما من مسائل وأحكام، وأما الجانب التطبيقي، فقد درسنا فيه التطبيقات المعاصرة للقبض الحكمي، وفيه إبراز لأهم الصور المستجدة للقبض الحكمي متمثلة في: قبض الشيك، وأسهم الشركات، وكذا البطاقات المصرفية، مع عرض آراء الفقهاء الباحثين المعاصرين في مدى اعتبارها قبضا شرعا تترتب عليها أحكامه وآثاره.This study Includes the subject of judgment capture of oney and its new practice in twe sides : theoritical and practical ، for the practical rooted side it includes the evidence of real copture and what they include : problews and judgment . for the thearitical side ، we study tre new ، practice of judgment capture which enhance the most important new images ; cash the check ، company shares ، bank cards and the expository of jurists opinions and the researchers to make it legally.
