Abstract

مع بدایة العمل المصرفي الإسلامي ظهرت الحاجة إلى وجود هیئة رقابة شرعّی ة تفتي وت ا رقب أعمال المصارف، وارتبطت هذه الّ رقابة ارتباطا وثیقاً بالمصارف الإسلامّی ة كارتباط الجسد بالّ روح، فلا وجود للمصارف الإسلامّی ة دون رقابة شرعّی ة، وتتحّد د مشكلة هذه الّد ا رسة في الوقوف على واقع الّ رقابة الشرعّی ة الحالي في المصارف الإسلامّی ة؛ إذ ت وُضّ ح من خلال مباحثها الّ رئیسّی ة حقیقة الّ رقابة الشرعّی ة بعرض مكوناتها، م ا رحل عملها، شروط أعضائها، وكیفّی ة تطبیقها داخل المصرف الإسلامي, حیث تمّی زت هذه الّد ا رسة بعرض دور الّ رقابة الشرعّی ة على بیع الم ا ربحة للآمر بالشّ ا رء ببنك البركة الج ا زئري وكیفّی ة تطبیقه وفق الضّ وابط الشّ رعیة، وانتهت الّد ا رسة بعرض بعض ال توّصیات المهّ مة للارتقاء بعمل المصارف الإسلامّی ة ومساعدة هیئة الّ رقابة الشّ رعیة على أداء أعمالها. Withe the beginning of the Islamic banking, The need for the sharia supervisory body has emerged, That body gives an aolvisory opinion and monitors the banking sectors, Its combination withe the Isamic banking became so vital that there would be no Islamic banks without a valid control simply just as the human being is a combination of both a spirit and body.This study aim is to examine the reality of the islamic banking sapervision displaying its facts, Components, Stages of work and how to apply all that process within the Islamic bank,the study she light on the role of the sharia supervisory on Murabaha sale by buying something from the Algerian bank El-Baraka and applying it in accordance with the sharia rules. The study was concluded by presenting some important recommendations to improve the work of the Islamic banks and help the sharia supervisory board gain ground.
