الصدقات وبعدها الاجتماعي بالغرب الإسلامي من خلال نوازل البرزلي

Abstract

يتباين موضوع الصدقات بين المعطى الاجتماعي والاقتصادي، مما يجعل البحث فيه وتقصي حقائق ممارسته من الصعوبة بمكان، وقد عرفته المجتمعات عبر العالم وفي مختلف الأزمنة. وهذا ما سنعمل عليه في مقالتنا من خلال رصد ظواهر ممارسة الصدقة ببلاد الغرب الإسلامي، انطلاقا من مجموع البرزلي؛ خصوصا الوقفية منها. حيث عالج حسب ما يحتويه من نوازل الفقهاء مغاربة وأندلسيين، كيفية توثيق العقود، أين تطرّق إلى ذكر أهم الشروط التي حدّدها الفقهاء خصوصا فيما يتعلّق بالشهادة، كما تناول أنواع الصدقات الممارسة؛ والتي تعدّدت أنواعها بحسب الممارسين لها والمستفيدين منها. استنادًا إلى نصوص الكتاب، تم استخلاص تسعة أنواع متميزة، وهي: الصدقة بين أفراد العائلة، وعلى المساجد، وعلى الفئات الهشة والمعوزين، وعلى الحصون والقلاع، وعلى المدارس والعاملين بها وطلبة العلم، وعلى المقابر والأضرحة، وصدقة المياه، وصدقة التعبّد والتوبة، وصدقات أهل الذمّة. وقد تناولت الدراسة أيضًا أثر وتأثير ممارسة الصدقة على الرابطة الأسرية والاجتماعية في بلاد الغرب الإسلامي، إضافة إلى الانتهاكات الممارسة في حق الأموال المحبّسة من طرف الفرد والمجتمع.The subject of charity represents a complex socio-economic phenomenon, which poses challenges to its investigation and empirical study due to its multifaceted nature Throughout history. This research delved into the authentication of contracts pertaining to charity, as discussed by Maghrebian and Andalusian jurists. We examined the essential conditions outlined by scholars, with special attention to the role of testimony in validating charitable acts. Furthermore, we explored the diverse forms of practical charity, discerning nine distinct types from the revelations contained within the compilation: Charity within familial networks. Contributions to mosques. Support for vulnerable groups and the needy. Assistance to fortifications and citadels. Patronage of educational institutions and scholars. Allocations for cemeteries and sacred sites. Endowments for water resources. Charitable endeavors focused on worship and repentance. Provision of aid to non-Muslim communities (dhimmis) Additionally, our research examined the ramifications of charitable practices on familial and social cohesion, shedding light on the intricate interplay between charity and communal bonds
