أحكام العطية للاولاد- دراسة ففقهية معاصرة

Abstract

"يتناول هذا البحث أحكام العطية للأولاد ـــ دراسة فقهية معاصرة ـــ الإشكال الرئيس فيها هو:ما الأحكام الفقهية التي تضبط العطية للأولاد؟ وقد حاولت في هذه الدراسة أن أجيب على هذا الإشكال في خمسة مباحث. تطرقت في المبحث الأول إلى مفهوم العطية ومشروعيتها والألفاظ ذات الصلة ، والمبحث الثاني عن أركان العطية وشروطها عند الحنفية والجمهور، وفي المبحث الثالث تكلمت عن العدل في عطية الأولاد، وأقوال الفقهاء فيه، وهي نقطة أساسية في هذا البحث، وفي البحث الرابع تحدث عن مسوغات التفضيل وأقوال الفقهاء فيها، وفي المبحث الأخير تطرقت إلى الحديث عن الرجوع في العطية، وتقسيم المال في الحياة. ومن أهم النتائج التي توصلت إليها من خلال هذه الدراسة، أنه لا خلاف بين العلماء في مشروعية العدل بين الأولاد في العطية، بل هو صفة أساسية مطلوبة في الأبوين لما لها من آثار إيجابية على الفرد والأسرة والمجتمع.. ""This research talks about the provisions of the gift for children - a contemporary jurisprudence study. The main problem in it was what are the jurisprudential rulings that control gifts to children? In the study, I tried to answer this problem in six sections In the first section, I explained the concept of gift and its legitimacy and related terms, and in the second one I talked about the pillars and conditions of the gift according to the Hanafi's and other Islamic scholars, in the third section I talked about justice in the gift of children, which is a key point in this research, the fourth section talk about the sayings of scholars on how to be fair in the gift and what the scholars preferred, and in the fifth section i talked about the justifications for preference and the sayings of the scholars in the justifications, and in the last topic I touched about the returning in gifts and the division of money in life. The most important findings of this study are that there is no disagreement among scholars regarding the legitimacy of justice among children in the gift, but rather it is a basic characteristic required in parents because of its positive effects on the individual, family and society "
