القواعد المقاصدية المتعلقة بمسائل النكاح المستجدة

Abstract

"تناول هذا البحث موضوع ""القواعد المقاصدية المتعلقة بمسائل النكاح المستجدة"" التي ظهرت مؤخرا، حاولت من خلالها إبراز دور القواعد المقاصدية في تنزيل الأحكام على النوازل المستجدة التي لا نص فيها، وذلك من خلال ثلاثة مباحث: يحتوي المبحث الأول على دراسة مفهوم القواعد المقاصدية، حيث قمت بتعريفها من الجانبين اللغوي والاصطلاحي، والفرق بين القواعد المقاصدية وبين القواعد الأصولية والفقهية، مع بيان أهميتها في التشريع، وهذا كان مقسم على ثلاثة مطالب. ثم انتقلت بعد ذلك إلى المبحث الثاني إلى بيان حجية القواعد المقاصدية في الاستدلال بها بشكل عام وأثرها في التكييف الفقهي، ثم بيّنت مراتب القواعد المقاصدية من حيث الموضوع، ومن حيث الكلية والعموم، ومن حيث صاحب القصد، ومن حيث دليلها الذي يقوى بحجيتها. وفي المبحث الأخير فقد خصصته لبعض الزيجات المعاصرة مع بيان الفرق بينها وبين الزواج الشرعي، مع ذكر الترجيح بين أقوال الفقهاء بالاستناد إلى قواعد المقاصد. وفي الأخير خلصت إلى خاتمة ذكرت فيها أهم النتائج التي توصلت إليها، وبعض التوصيات التي آمل أن تلقى الاستجابة. ""This research dealt with the subject of the maqasid rules related to the emerging issues of marriage that have emerged recently, through which l tried to highlight the role of the maqasid rules in applying rulings on emerging issues that do not have a text, through three detectives: The first chapter contains a study of the concept of the maqasid rules, where I defined them form the linguistic and idiomatic sides, and the difference between the maqasid rules and he fundamentalist and jurisprudential rules, with an indication their importance in legislation, and this was divided by three claimants. Then I moved on to the second research to explain the authoritativeness of the intentional rules in inferring them in general and their impact on jurisprudential conditioning. In the last research, I devoted it to some contemporary marriages, explaining the difference between them and legal marriage, and mentioning the weighting between the sayings of scholars based on the rules of purposes. Finally, I came to a conclusion in which I mentioned the most important findings that I reached and some recommendations that I hope will receive a response. "
