استبدال الوقف في الفقه الإسلامي - دراسة فقهية مقاصدية-

Abstract

"الملخص تناولت هذه المذكرة موضوع استبدال الوقف في الفقه الإسلامي للاجابة على اشكاليته الأساسية المتمثلة في الأسئلة التالية: ما هي آراء الفقهاء في استبدال الوقف؟ وماهي ضوابطه؟ وما مدى اعتبار المقاصد في استبدال الوقف؟. وقد إحتوت المذكرة على ثلاثة مباحث، المبحث التمهيدي لبيان مفهوم الوقف ومشروعيته، وأركانه، وأنواعه ثم مقاصد الوقف، فالمبحث الأول لحقيقة استبدال الوقف وضوابطه في أربعة مطالب، أما المبحث الثاني فبينت فيه أثر اعتبار المقاصد في استبدال الوقف وذلك من خلال بيان قاعدة مراعاة القصد دون اللفظ في الوقف، ومقاصد استبدال الوقف الدينية والاجتماعية والاقتصادية، ثم القصد من استبدال الوقف العامر، ومراعاة المقاصد في توجيه ثمن الوقف. وفي الختام ختمت المذكرة بذكر أهم النتائج المتوصل إليها، وبعض التوصيات الهامة. " " This dissertation dealt with the issue of replacing the waqf in Islamic jurisprudence and its importance , that was an action to answer all the basic questions of the following thesis which are : What are the views of jurists in the replacement of the waqf ? What are its basic principles ? And what is the extent to which the purposes of replacing the waqf are considered? This dissertation contained three investigations . the first section dealt with the fact of replacing the waqf and its four controlling principles . the second section showed the effect of considering the purposes of replacing the waqf through the statement of the rule of intention without saying the endowment, and the replacing of the waqf and it’s Religious , social and economic purposes, and then the intention to replace the waqf, also taking into account the purposes of directing the price of the waqf. In conclusion, this dissertation concluded by mentioning the main findings of the topic been dealt with and some important recommendations. "
