Abstract

(التطعيم مثل أي عمل طبي لا يخلو من المخاطر تماماً ؛ لأنه يمكن أن تحدث في بعض الحالات حوادث طبية بعد الحقن، وهو ما يثير نظاماً للمسؤولية عن الأضرار الي تلحق بالأفراد جراء ذلك ؛ لاسيما فيما يتعلق بشروط تنفيذ هذه المسؤولية و صعوبة إثباتها و العلاقة السببية بين التطعيم و الأعراض التي تليها ،حيث وجد أنه حتى في حال وصف نظام المسؤولية على أساس الخطأ من قبل الممارسين الطبيين يمكن أن يؤدي ذلك إلى تفسيرات قضائية كبيرة و متغيرة ؛ لذلك فإن هذه المقالة تقدم مجموعة من التساؤلات القانونية عن هذه المسؤولية غير الواضحة في هذا المجال والوقت بالذات المرتبط بالتطعيم ضد الفيروس التاجي كورونا- كوفيد 19-).
