Abstract

يشهد العالم ثورة معلوماتية و رقمية تكاد لا تعرف حدودا و لا تفرض قيودا على أي مجال من مجالات الحياة .ويعتبر القضاء بشكل عام قطاعا حساسا يعمل على ضبط تعاملات الأفراد مع بعضهم أو مع الهيئات والمؤسسات وما ينتج عنها من نزاعات ،و يتأثر بدوره بالمستجدات الحاصلة في العالم السلبية منها أو الايجابية ،إذ نجد أن تنقل القضاء من شكله التقليدي إلى الالكتروني يمثل في حد ذاته قفزة نوعية من حيث الاجراءات وخصوصية في الأحكام القضائية . The world is witnessing an information and digital revolution that knows almost no limits and does not impose restrictions on any area of life. The judiciary is generally a sensitive sector based on controlling individuals transactions with each other or with bodies and institutions and in turn is affected by developments around the world, whether negative or positive. The transfer of the judiciary from its traditional form to the electronic represents in itself a qualitative leap in terms of the procedures applied and the privacy of the judicial decisions.
