مراعاة البعد المقاصدي لأحكام الوقف في الفقه الإسلامي

Abstract

يتطرق ىذا البحث إلذ موضوع من أىم ات١وضوعات الفقهية، ألا وىو الكشف عن أثر ات١قاصد الشرعية بُ أحكام الوقف بُ الفقو الإسىلبمي، ويهدف إلذ بيان حاجة بعض أحكام الوقف إلذ ات١قاصد الشرعية من أجل تفعيل ىذه الأحكام بُ المجتمع. وقد تطرقت بُ ات١بحث الأول إلذ مفهوم الوقف و ات١قاصد الشرعية والعلبقة بينهما، وبُ ات١بحث الثالش تناولت بعض مقاصد الوقف الدينية والاجتماعية والاقتصادية، أما ات١بحث الأختَ فتطرقت فيو إلذ بعض ات١سائل ات١ختارة، لنعرف من خلبت٢ا أثر ات١قاصد بُ بعض الأحكام الفقهية ات١تعلقة بالوقف. وبُ ات٠ات٘ة توصلت إلذ بعض النتائج و التوصيات. الكلمات ات١فتاحية: الوقف ات١قاصد الشرعية الأحكام الفقهية Abstract This research paper consists of three chapters; the first chapter is dealing with the definition of two concepts; Waqf and the purpses of Sharia. The second chapter is tackling some purposes of waqf; the religious, the social and the economic one. The last chapter is analyzing some selected issues in fikh in order to know the impact of the purpses of sharia on some laws of fikh which is related to waqf. Finally, the conclusion of this research is talking about the findings obtained from this research and some recommendations. Key words Waqf, The purposes of Sharia, Fikh laws
