التدابير الاحترازية لمكافحة المخذرات والمؤثرات العقلية في الفقه الاسلامي والقانون الجزائري

Abstract

يدرس هذا البحث آفة المخدرات والمؤثرات العقلية من منظور فقهي وقانوني، وتهدف الدراسة لفت النظر إلى جريمة تعاطي وترويج المخدرات وغيرها من المؤثرات العقلية، سواء بالنسبة للمجتمع أو المشرع، وذلك للخطورة الشديدة التي تمس الأفراد وحتى الدولة في اقتصادها ومؤسساتها، وجاءت الدراسة مقسمة لثلاث مباحث يحمل كل مبحث منها جانب معين وقد جاءت كما يلي المبحث الأول: ماهية المخدرات والمؤثرات العقلية، المبحث الثاني: الذي بعنوان عوامل انتشار المخدرات والمؤثرات العقلية وآثارها، المبحث الثالث: بعنوان جرائم المخدرات والمؤثرات العقلية في ضوء الفقه الاسلامي والقانون الجزائري، ومن أهم نتائج هذه الدراسة أن المخدرات والمؤثرات العقلية لها أخطار جسيمة على العقل والجسم، وعلى الفرد والمجتمع، لذلك فإن تعاطيها وترويجها وبيعها وزراعتها وتسويقها محظور ويعاقب عليه القانون والشريعة الاسلامية.This research studies the scourge of drugs and psychotropic substances from a doctrinal and legal perspective, and the study aims to draw attention to the crime of abuse and promotion of drugs and other psychotropic substances, whether for society or the legislature, due to the severe danger that affects individuals and even the state in its economy and institutions, and the study was divided into three sections carrying Each topic has a specific aspect and it came as follows: The first topic: What drugs and psychotropic substances are, the second topic: which is entitled Factors of the Spread of Drugs and Psychotropic Substances and Their Effects, the third topic: Narcotics and Psychotropic Substances Crimes in the Light of Islamic Jurisprudence and Algerian Law, and one of the most important results of this study is that Narcotics and psychotropic substances have grave dangers to the mind and body, and to the individual and society. Therefore, their use, promotion, sale, cultivation and marketing is prohibited and punishable by law and Islamic law.
