الظروف المؤثرة في العقوبة من خلال أحكام قانون الوقاية من التمييز وخطاب الكراهية

Abstract

يعتبر مبدأ التفريد القضائي للعقوبة من بين أهم المبادئ في السياسة الجنائية الحديثة، حيث يقتضي اتصال كل جريمة بظروفها المحيطة بها، لتأتي هذه الدراسة التي تهدف إلى معرفة إستراتيجية المشرع الجزائري في معالجة مسألة هذه الظروف المؤثرة في العقوبة من خلال أحكام القانون رقم 20-05 المتضمن الوقاية من التمييز وخطاب الكراهية، وكيف عالج أنواعها وبيّن آثار اتصالها بالعقوبات المقررة للجرائم المتناولة في طيات هذا القانون. وقد اتضح من خلال هذه الدراسة أن المعالجة التشريعية لمسألة الظروف المؤثرة في العقوبة من خلال أحكام هذا القانون قد أخذت أسلوبي التشديد والتخفيف من خلال ظروف قانونية مشددة، وأخرى معفية ومخففة، إضافة إلى ظروف قضائية مخففة :Abstract One of the most important principles of modern criminal policy is the principle of judicial discontinuity of punishment, in which each crime must be connected to its surrounding circumstances. This study, which aims to determine the Algerian legislature's strategy to address the issue of such conditions affecting punishment, contained in provisions of Law No. 20-05, which includes prevention of discrimination and speech Hatred and how it dealt with its types, and the effects of its connection with the penalties established for offenses covered by this law. The study found that the legislative processing of the issue of conditions affecting punishment through the provisions of the Law, had introduced the methods of tightening and mitigation through strict legal circumstances, and others exempt and mitigating, as well as reduced judicial circumstances.
