الحماية الجنائية للمعطيات الشخصية للمستهلك الالكتروني دراسة مقارنة

Abstract

أدى التطور السريع لتقنيات الإعلام والاتصال إلى توسع ميادين المعاملات الالكترونية، وهذا يتطلب من المستهلك الالكتروني إرسال معطياته الشخصية إلى التاجر لإكمال المعاملات، وقد تكون تلك المعطيات عرضة للاعتداء عليها إذا لم يحافظ المتلقي على سريتها وسلامتها. وقد أدت الجرائم التي تمس بالمعطيات الشخصية للمستهلك الالكتروني، إلى صدور الكثير من القوانين بهدف توفير الحماية اللازمة لهذه المعطيات خاصة الحماية الجنائية لها، أبرزها القانون الفرنسي رقم 78-17 المتضمن نظم المعالجة المعلوماتية والحريات، والقانون الجزائري رقم 18-07 المتضمن حماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، بالإضافة إلى قانون العقوبات. Abstract: The rapid development of information and communication technologies has led to the expansion of the fields of electronic transactions, and this requires the electronic consumer to send his personal data to the merchant to complete the transactions, and these data may be subject to attack if recipient does not maintain its confidentiality and integrity. Crimes that affect the personal data of electronic consumer personal data have led to the issuance of many laws with the aim of providing the necessary protection for these data, especially criminal protection for them, most notably French Law N°, 78-17, which includes information processing systems and freedoms, and Algerian Law N°,18-07, which includes the protection of natural persons.
