قاعدة اعتبار المآل و أثرها في النوازل الطبية المعاصرة

Abstract

"مع التطور الهائل في التقنيات الحديثة - لاسيما في مجال الطب - جاءت هذه الدراسة والتي بعنوان "" قاعدة اعتبار المآل وأثرها في النوازل الطبية المعاصرة"" تبحث في مدى تأثير القاعدة المذكورة في الحكم على مجموعة من النوازل الطبية المعاصرة. بنينا الدراسة على فصلين، عني الفصل الأول ببيان الجانب النظري للقاعدة، وخصص الثاني لتطبيق القاعدة على بعض النوازل الطبية المعاصرة، وهذا من خلال ذكر نماذج مبنية عليها أو بكونها سببا في تغير الحكم على النازلة. توصل البحث إلى نتائج أهمها أن اعتبار مآلات الأفعال سبب في التنزيل الصحيح والأمثل للأحكام، ومانع من مناقضة مقاصد الشريعة أو التحيل عليها، مما يترك أثرا واضحا جليا أن الشريعة صالحة لكل زمان ومكان إذا ما نزلت التنزيل الصحيح. ""With the immense evolution in modern technologies، especially in the medical field، this study، which was entitled: "" The rule of assumption of results and its effect on the contemporary medical issues""، was conducted to explore the effect of the previously mentioned rule on a group of contemporary medical issue This study was made of two chapters. The first chapter tackled the theoretical side of the study، while the second chapter was used to apply the rule on some new medical issues. This was through including some samples which were based on this rule، or being a reason for changing the rule of the issue. The study came up with some findings، most importantly was that the assumption of results of acts is the right for the rules، as well as a boundary from contradicting these religious rules. This leaves an apparent and a clear effect that shari'a is valid for all times and places if used the right rules. "
