التسوية الوقائية من الإفلاس على ضوء نظام الإفلاس السعودي ولائحته التنفيذية

Abstract

صدر نظام الإفلاس السعودي الجديد متضمناً تفاصيل إجراءات الإفلاس السبعه، وهي التسوية الوقائية من الإفلاس، إعادة التنظيم المالي، التصفية، التسوية الوقائية لصغار المدينين، إعادة التنظيم المالي لصغار المدينين، إجراء التصفية لصغار المدينين، التصفية الإدارية. من أهداف هذا النظام تحقيق الموازنة بين مصالح المتعثر او المفلس مع دائنية، تحت اشراف المحكمة التجارية التي ينعقد لها الاختصاص بنظر وتطبيق إجراءات نظام الافلاس ولائحته التنفيذية. كما يهدف لخلق مناخ استثماري اكثر جاذبية للمستثمرين واكثر طمأنينةً واستقراراً ووضوحاً في التعاملات التجارية، حيث تعزز هذه البيئة القانونية الجاذبة للمستثمرين مكانة المملكة اقتصادياً. وتضيف عنصراً مكملا لمنظومة الإصلاحات الاقتصادية لتحقيق رؤية المملكة العربية السعودية (٢٠٣٠). تناولت هذه الدراسه ماهية الإفلاس المعنية في أحكام هذا النظام، كما تناولت الجانب الاجرائي لتقديم طلب التسوية الوقائية من الإفلاس بدايةً من حالات تقديم الطلب الى المحكمة وحتى انتهاء اجراء التسوية الوقائية ومايترتب عليها من جزاءات. Summary of the research : The new Saudi bankruptcy system was issued including details of the seven bankruptcy procedures, which are preventive settlement of bankruptcy, financial reorganization, liquidation, preventive settlement of small debtors, financial reorganization of small debtors, liquidation procedure for small debtors, and administrative liquidation. One of the objectives of this system is to achieve a balance between the interests of the defaulting or bankrupt with creditors, under the supervision of the commercial court that has jurisdiction over the consideration and implementation of the bankruptcy system procedures and its implementing regulations. It also aims to create an investment climate that is more attractive to investors and more reassuring, stable and clear in commercial dealings, As this legal environment attractive to investors enhances the Kingdom's economic position. It adds an integral element to the system of economic reforms to achieve the vision of the Kingdom of Saudi Arabia (2030). This study deals with the nature of bankruptcy concerned in the provisions of this system, as well as the procedural aspect of submitting a preventive settlement request from bankruptcy, starting from the cases of submitting the application to the court until the end of the preventive settlement procedure and the penalties arising therefrom.
