مهددات الأمن الأُسري في ضوء الشريعة والقانون

Abstract

الملخص هذه الدراسة موسومةٌ بـ: (مهددات الأمن الأُسري في ضوء الشريعة والقانون)، وإشكاليتُها الرئيسةُ التي حاولَت الإجابةَ عنها تتمحور حول: ما المهددات التي تنسف بالأمن الذي يُخيِّمُ على الأُسرة في الشريعة والقانون؟ وللإجابة عن هذا الإشكال وضعت خطة تتضمن مقدمة، وثلاثة مطالب؛ خُصِّصَ أولهم للإهمال الأُسري، وجُعِلَ ثانيهم للعنف الأُسري، أما ثالثهم وُضِعَ لوسائل التواصل الاجتماعي، وكل ذلك يُعرضُ في ضوء الشريعة والقانون، وخاتمة، وفهرس المصادر والمراجع. ومن أهم النتائج التي وصلت إليها الدراسة: اهتمت الشريعة الإسلامية بالأُسرة، وجعلت لها ضوابط وحددت لها الأهداف الكفيلة بصيانتِهَا والمحافظة على بنائِهَا واستقامة كيانِهَا؛ وذلك بوضْعها نظامًا وقائيًّا وآخر علاجيًّا يكفل لها حل المشكلات والخلافات التي تطرأ عليها، وتهدد استقرارها أو استمرارها. كما أهتم المشرع الجزائري بالأُسرة؛ وذلك بتقنين نصوص تدعو لحمايتِهَا، لا سيّما من خلالِ تجريم الأفعال الماسة بنظامِ الأُسرة؛ كالإهمالِ الأُسري والعنفِ الأُسري. وأوصت الدراسةُ بوجوبِ الأخذ بأحكامِ الشريعة الإسلامية، بخصوصِ جرائم التخلِّي عن الالتزاماتِ الأُسرية والعنف الأُسري من قِبَل المشرع الجزائري؛ تحقيقًا لحمايةٍ أكمل وأشمل لها من كل انحراف وتفكك وتصدع، على أن يكون ذلك في تقنين جديد متخصص في الجرائمِ الأُسريةِ، يسمى "قانون العقوبات الأُسري". Among the most important findings of the study : Islamic law focused on the family, And I made controls for it and set goals for it to maintain it and preserve its construction and integrity of its being ; By putting in place a preventive system and a remedial system that guarantees the solution of problems and disputes that arise in it and threaten its stability or continuity. The Algerian legislator also cared about the family ; This is by codifying texts that call for its protection, especially by criminalizing acts affecting the family system ; such as family neglect and domestic violence. The study recommended that the provisions of Islamic law should be adopted, regarding the crimes of abandoning family obligations domestic violence by the Algerian legislator ; In order to achieve a more complete and comprehensive protection for it from every deviation, disintegration and crack, provided that this is in a new codification specialized in family crimes, called the “Family Penal Code
