دراسة تحليلية للآليات المقررة لحماية الأسرة في التشريع الجزائري صندوق النفقة نموذجا

Abstract

على الرغم من توطيد مكانة المرأة في المجتمع الجزائري ، غالباً ما تجبر النساء المطلقات الحاضنات خاصة على التردد على أروقة المحاكم بين الفينة والأخرى آملة الحصول على نفقة أولادها، لكن دون جدوى ، كما ترك الإفلات من العقاب بالنسبة للمتعنت والممتنع عن دفع النفقة تساؤلات دون إجابة. والمشرع، حاول إيجاد حل لضمان النفقة غير المدفوعة ... مما أثار جدلا كبيرا في أوساط المجتمع عن مدى نجاعة هذه الآلية ، وبعد مدة أقر كل من مجلسي الأمة والبرلمان، مشروع هذا القانون فدخل صندوق النفقة رسميا حيز النفاذ. بعد نشره مؤخراً في الجريدة الرسمية ووضع إجراءات لفائدة الرسوم المالية. بموجب القانون رقم 15-01، بتاريخ 4 يناير 2015، و تم تجهيز الترسانة القانونية بآلية جديدة لحماية القاصرين والنساء المطلقات الحاضنات. وهذا ما يجعلنا نتساءل ما هي أفضل الممارسات التي يقدمها صندوق النفقة لتحقيق أهداف الحماية وفقا لقيم الكرامة والعدالة الاجتماعية. الكلمات المفتاحية : أسرة ، صندوق النفقة ، الحماية ، الآليات . Despite the consolidation of the status of women in Algerian society, divorced women often drag themselves into the workings of the courts. Just as impunity leaves the record of child support unanswered. The legislator, sensitized on this subject has just made a big decision: creation of a guarantee fund for unpaid alimony payments. After having provoked a strong controversy, within the society and after having been adopted by both Houses of Parliament, The alimony fund to protect the family and minor children officially entered into force after its recent publication on the Official Journal and the definition of procedures to benefit from royalties procedures. Pursuant to Law No. 15-01 of 4 January2015, establishing the alimony fund, the legal arsenal has been reinforced with a new mechanism for the protection of minors and divorced women exercising the custody rights which now benefit from support in the event of dereliction by the debtor.
