الحماية الجنائية للعرض دراسة مقارنة بين الشريعة الإسلامية و القانون الجزائري

Abstract

تضمن موضوع مذكرتي الحماية الجنائية للعرض بين الشريعة الإسلامية والقانون الجزائري حيث عالج كل من الضمانات الجنائية للعرض التي كفلتها الشريعة الإسلامية والقانون الجزائري، وذلك من خلال وضع تدابير وقائية تمنع الجريمة قبل وقوعها كالاستئذان والأمر بالنكاح وستر العورة، واهتم كل التشريع الجنائي الإسلامي والقانون الجزائري بحماية العرض بوضْعِهماَ عقوبات رادعة منها الجلد والنفي في الشريعة الإسلامية والحبس والغرامة المالية في التشريع الجزائري، ويتضح كذلك حرص كل منها على حماية العرض لكن يَتَبَيَنُ أن الشريعة الإسلامية في حمايتها للعرض أوسع نطاقاً من التشريع الجنائي الجزائري. Both the Islamic and Algerian legislation concerned the protection of reputations by imposing deterrent penalties such as flogging and exile in Islamic law, imprisonment and a fine in Algerian legislation. It is also clear that each is keen to protect reputation. But it is argued that Islamic law protects reputation from a wider range of Algerian criminal legislation.
