أحكام أجهزة منع الحمل طويلة المفعول (LARC) في الفقه الإسلامي

Abstract

"الملخص موضوع المذكرة موسوم بـ: ""أحكام أجهزة منع الحمل طويلة المفعول (LARC) في الفقه الإسلامي"". وقد تمت دراسته في مبحثين؛ الأول: خُصِّص لدراسة ماهية أجهزة منع الحمل طويلة المفعول (LARC)، وبيان أهميتها في تنظيم النسل، وآثار استعمالها على جسم المرأة، كما تناول أحكام استعمال هذه الأجهزة في ظل المقاصد الشرعية، وبيّن القواعد الفقهية الحاكمة لذلك الاستعمال، وأما المبحث الثاني فتعرّض لحكم استعمال أجهزة منع الحمل طويلة المفعول (LARC) لتنظيم النسل وآثارها الفقهية؛ بداية بدراسة حكم تنظيم النسل بوجه عام، وانتهاءً بحكم استعمال الغرسات واللوالب لتنظيم النسل وآثارها الفقهية. ومن أهم النتائج التي خَلُصَت إليها هذه المذكرة؛ أنّ الحكم العام لأجهزة منع الحمل طويلة المفعول (LARC) هو الحرمة؛ كونها متسببة في الإجهاض، ومحل الجواز فيها ما كان في حدود الضرورة أو الحاجة المعتبرة التي تدعو المرأة لاستعمالها، مع مراعاة الضوابط الشرعية، كما تقترح الدراسة تجديد البحث الفقهي في هذه الأجهزة باستمرار؛ تماشيا مع المستجدات الطبية المتعلقة بها. "Abstract The subject of the dissertation is: ""The Provisions of Long-Acting Reversible Contraception Devices (LARC) in Islamic Jurisprudence"". It has been studied in two sections; the first is dedicated to studying what LARCs are, and indicating its importance in birth control, and the effects of its use on the woman’s body, It also addresses the provisions using LARCs in light of the legitimate purposes, and it clarifies the jurisprudential rules governing that use. The second section is devoted to the ruling on LARC’s use for birth control and their jurisprudence effects starting with the birth control in general, and ending with the rule of using implants and spirals for birth control and their jurisprudence effects. Among the most important findings of this dissertation is the sanctity of using LARCS for being an abortion. It is permissible within the limits of the necessary or significant need that calls for the woman to use it, taking into account Sharia regulations, The study also proposes to renew the jurisprudence research in these devices continuously in line with the related medical developments.
