التشريع المصلحي المعاصر

Abstract

يقدم هذا البحث معالجة شرعية لمبدأ الأخذ بالمصلحة المرسلة نظريا من خلال التطرق إلى مفهومها وشرعيتها في حدود الاعتبار بشروطها ومراعاة ضوابطها التي تجعلها تساير متطلبات العصر دون مصادمتها للنصوص الشرعية . ذلك لأن النصوص الشرعية متناهية والحوادث والمستجدات غير متناهية، وعليه فحيثما وجدت المصلحة الحقيقية الملائمة لمقاصد الشرع فثم شرع الله، وليس على إطلاقها، حيثما وجدت المصلحة الملائمة لروح التشريع فثم شرع الله . هذا وقد جاء هذا البحث مؤكدا مرونة الشريعة الإسلامية من خلال بعض النماذج التطبيقية التي أساسها المصلحة المرسلة المسايرة لمتطلبات العصر ومدى قدرتها على حل المشكلات المستجدة، في إطار مقاصد الشريعة الإسلامية. كون المصلحة في الشريعة الإسلامية شاملة للمنافع الروحية والمادية والدنيوية والأخروية، وملائمة للدين ومتفرعة عنه بخلاف المصلحة في الأنظمة الوضعية. The summary: This research presents a legal treatment to the principle of the free benefit. This subject is detailed through the following sub- titles: The definition of the free benefit, its legality, the conditions and rules which lead and guide the free benefit to go with the real needs without any conflicts with the legal texts. We Know that the legal texts are limited, and the actions and needs are limitless, so, we find the legal act wherever find real benefit, which is surely adequate to the aims of shari’a. This research emphasized on the flexibility of the Islamic Shari’a through some practical examples related to the free benefit. This later might be up to date , and able to solve the new problems. The free benefit in Islamic shari’a is wide, containing the spiritual material benefit, related to this life, or the other life. Our religion used to accept and save the benefits, in contrary to the human systems. This research discussed what is summarized above.
