الحقوق المالية للمرأة بين الشريعة والقانون

Abstract

ملخص البحث موضوع البحث يتعلق بعنصر مهم في المجتمع الذي لا يقوم ولا يصلح إلا بصلاحه وهو المرأة، وهذا الجانب من الدراسة يتعلق بالحقوق المالية للمرأة في الشريعة الاسلامية والقانون المدني الجزائري، ألا حيث جمعت بين واقع حقوق المرأة قبل الإسلام من حرمان وظلم ... وبين واقعها في المجتمعات الغربية التي أعطتها كامل حريتها دون التقيد بأحكام الشرائع السماوية وذلك بتحميلها مسؤوليات أكثر من طاقتها إلى درجة إهمالها لبعض واجباتها ، وبين ما أعطاها الإسلام من حقوق وكرامة وعزة ..... فقد حاول هذا البحث الإجابة على عدة إشكالات أبرزها: ما مدى رعاية الإسلام للحقوق المالية للمرأة ؟. وفيم تتمثل هذه الحقوق في نظر الشريعة الإسلامية وفي نظر المشرع الجزائري؟. وتوج البحث في ختامه ببعض النتائج والتوصيات منها: رقي الإسلام وعدله في نظرته للمرأة حيث أعطاها حقوقها المالية كاملة غير منقوصة، وحررها من كل القيود التي تسلبها إياها وأهليتها في التصرف والتملك، وساواها In this research, we'll examine an important element in society Namely women, Where women are very important for the reform of society. At last we came to some conclusions and recommendations including: Promoted Islam and justice in his view of women that it gave her financial rights as uncompromised , and liberated from all the restrictions that take away them and their eligibility to act and acquisitions , equated her brother man in rights and duties are him , and he them .
