الأليات القانونية لحماية ضحايا التمييز وخطاب الكراهية في التشريع الجزائري

Abstract

تضمن القانون 20-05 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما بموجب أحكام الفصل الثالث منه أليات خاصة لحماية ضحايا الاعتداءات التي يجرمها هذا القانون، وذلك استجابة لنداءات المجتمع الدولي وتكييف الجزائر لأحكام قوانييها مع الاتفاقيات الدولية. وتتعلق صور الحماية بتيسير لجوء الضحايا إلى القضاء للمطالبة بحقوقهم، ومنها ما يتعلق بما يخلفه هذا النوع من الجرائم من آثار مادية ونفسية على هؤلاء الضحايا ومحاولات التخفيف منها. كما تبرز لناخصوصية الحماية أيضا في استحداث اللجوء للقضاء الإستعجالي لهذه الفئة واستفادتهم من المساعدة القضائية بقوة القانون. Abstract: Law 20.05 on the prevention and control of discrimination and hate speech under chapter III provisions contained special mechanisms for the protection of victims of attacks criminalized by the Act, in response to calls from the international community and Algeria's adaptation of its laws to international conventions. The protection images relate to facilitating the access of victims to justice to claim their rights, including with regard to the material and psychological effects of this type of crime on these victims and attempts to mitigate them. We are also protected in the development of asylum for the urgent judiciary of this group and their use of legal aid by force of law.
