هيئة الرقابة الشرعية المركزية في الجزائر بين التنظير والتطبيق

Abstract

عتبر الفتاوى والرقابة الشرعية حجر الأساس لبناء الصناعة المالية الإسلامية، وقد أوكلت هذه المهمة إلى هيئات على مستويات مختلفة. سواء على المستوى الداخلي للمؤسسات المالية الإسلامية، فأطلق عليها هيئات الرقابة الشرعية الداخلية، أو على مستوى هرم النظام المالي الإسلامي، وبذلك سميت هيئات الرقابة الشرعية العليا. من خلال هذه الورقة، سنسلط الضوء على الإطار النظري لهيئات الرقابة الشرعية العليا مع الإشارة إلى الهيئة الشرعية الوطنية للإفتاء للصناعة المالية الإسلامية والدور المنوط بها لدعم الصناعة المالية الإسلامية في الجزائر. سنخلص إلى أن هذه الهيئة تسعى جاهدة لإضفاء الشرعية على عمل المؤسسات المالية الإسلامية الناشطة في الجزائر، إلا أنها تواجه تحديات تعيق تحقيق أهدافها. Fatwas and Sharia oversight are considered the cornerstones of the Islamic financial industry. This responsibility has been entrusted to bodies operating at different levels. At the internal level of Islamic financial institutions, these are referred to as internal Sharia supervisory boards, while at the higher level (the apex of the pyramid) of the Islamic financial system, they are known as higher Sharia supervisory bodies. Through this paper, we will explore the theoretical framework of higher Sharia supervisory bodies, with a focus on the National Sharia Board for Fatwa in the Islamic Financial Industry and its role in supporting the Islamic financial sector in Algeria. We will conclude that this body strives to legitimize and ensure the sound operation of Islamic financial institutions active in Algeria, though it faces challenges that hinder the achievement of its objectives.
