Abstract

This research is a study of Fiqh subject in the family under the title of ‘ Nikah Misayar ‘ which is ‘ traveler marriage ‘ – study in Fiqh Muquaran – I relayed on Fiqh Muquaran study to see how much it does agree with the Islamic legislation . It was built in the introductory study which is of Islamic marriage , and three other studies of traveler's marriage . The first study is about its reality and some of its legislations , the second is about its legality between the current scientists . The last study was about some of its positive. and negative impacts and its relation to the other close types of marriage. In conclusion , there was a group of results . The most important one was that traveler's marriage has completed corners and conditions but the wife is obliged to give up some of her rights like money and sleep . It is a legal type of marriage and one of its conditions is that benefit predominate harm . It is only done in a necessary cases.
