حقوق الأشخاص ذوي الاحتياجات الخاصة في التشريع الجزائري- دراسة في القانون 02-09

Abstract

تشكل حماية حقوق الأشخاص ذوي الاحتياجات الخاصة ،والاعتراف بها من أهم الالتزامات المرتبطة بحقوق الإنسان باعتبارها فئة تحتاج إلى رعاية وتأهيل مجتمعي ، مما استدعى ضرورة الاعتراف بحقوقهم ضمن جملة من النصوص القانونية الوطنية والدولية ، وهو ماجاء به المشرع الجزائري حيث أقر بموجب القانون رقم 02-09 لسنة 2002 ، و المتعلق بحقوق الأشخاص المعوقين وترقيتهم جملة من الحقوق لهذه الفئة، والتي جاءت في مجملها تهدف إلى حمايتهم من كل أشكال التهميش واللامبالاة. Abstract : The protection and recognition of the rights of persons with special needs is one of the most important human rights obligations, as a group that requires community care and rehabilitation , which necessitates the recognition of their rights within a range of national and international legal texts. This is what the Algerian legislator said according to law no02-09 concerning the protection and promotion of persons with Disabilities for the year 2002 , a set of rights were granted to this group, which were aimed at protecting them from all forms of marginalization and indifference .
