حرية النشاط السمعي البصري والضمانات القانونية لاستقلالية سلطة الضبط في ظل التشريع الجزائري

Abstract

تتناول هذه الدراسة ضمانات حرية النشاط السمعي البصري ودور سلطة ضبط السمعي البصري في الجزائر التي أنشئت بالقانون العضوي 12-05، حيث تتمحور إشكالية الدراسة حول ضمانات منح رخص إنشاء القنوات التلفزيونية وكذا ضمانات استقلالية أداء هذه الهيئة الإدارية المستقلة من خلال الصلاحيات التي وضعها المشرّع في قانون الإعلام 12-05، والقانون 14-04 المتعلق بالنشاط السمعي البصري. وخلُصت الدراسة إلى وجود تداخل واضح في الصلاحيات بين سلطة الضبط ووزارة الاتصال، فضلا عن الأداء الضعيف لسلطة الضبط. وتوصلت الدراسة إلى أن قانون الإعلام وقانون النشاط السمعي البصري في الجزائر يجب تعديلهما سيما ما تعلق بتشكيلة الهيئة بإدراج ممثلين للإعلاميين والهيئات القضائية. This study deals with guarantees of freedom of broadcasting activity and the role of the broadcasting regulatory authority in Algeria, which was established by the organic law 05-12, where the problem of the study revolves around guarantees of granting licenses to establish television channels as well as guarantees for the independence of the performance of this independent administrative body through the tasks set by the legislator in the law Media 12-05, and Law 04-14 on audiovisual activity. The study concluded that there is a significant overlap in the tasks between the control authority and the Ministry of Communication, as well as the lack of performance of the control authority. The study concluded that the law on media and the law on audiovisual activity in Algeria must be amended, especially with regard to the composition of the body by including representatives of media professionals and judicial bodies.
